Welcome to Lots of Costumes. These Terms of Service apply when you visit, browse, shop from, or otherwise use the Lots of Costumes website, online store, products, content, tools, features and related services. In these Terms, “we”, “us” and “our” mean Lots of Costumes, operated by Ruddle Marketing. “You” means the customer, visitor, or person using our website or services. Lots of Costumes is powered by Shopify, which helps us provide our online store and checkout services. By using our website or placing an order, you agree to these Terms of Service, together with any policies linked or referenced here, including our Privacy Policy, Shipping Policy, and Returns & Refunds Policy. Please read these Terms carefully. They include important information about orders, payments, shipping, returns, product information, third-party services, disclaimers, and limits of liability. If you do not agree with these Terms or our Privacy Policy, please do not use our website or services.

By using our website or placing an order, you confirm that you are old enough to shop online in your country, state, or province, or that you have permission from a parent or guardian. You agree to use our website and services only for lawful purposes. You may be asked to provide information such as your name, email address, billing details, payment details, shipping address, and order information. You are also responsible for any activity that happens through your account. You must not transfer, sell, assign, or share your account in a way that allows someone else to misuse our services.

SECTION 2 - OUR PRODUCTS

We aim to make our product information clear, accurate, and useful so you can choose the right costume for your occasion. Product photos, colours, packaging, included accessories, materials, sizing, and small design details may vary slightly from what appears on screen. This can happen because of screen settings, supplier updates, product batches, or photography differences. Costume sizing can vary between products and suppliers. Please check the product description, size guide, measurements, and included items before ordering. If you are unsure, contact us before you buy and we will do our best to help. We may update, change, limit, or discontinue products at any time. Product availability is not guaranteed until your order has been accepted and processed. We do not guarantee that a costume will be suitable for every event, activity, weather condition, venue rule, school rule, workplace rule, or local requirement. Please check any event or safety requirements before ordering.

SECTION 3 - ORDERS

When you place an order, you are making an offer to buy the selected product or products. Your order is not accepted until we confirm it and your payment has been processed. We may accept, decline, cancel, or adjust an order where reasonably needed, including if there is a payment issue, suspected fraud, stock issue, fulfilment issue, pricing error, product error, delivery restriction, or problem with the information provided at checkout. Please check your order carefully before submitting it. Once an order has started processing with our fulfilment partners, we may not be able to change or cancel it. If we need to cancel or change an order, we will try to contact you using the email address, billing details, shipping details, or phone number provided at checkout. Your purchases are subject to our Returns & Refunds Policy. Products sold through Lots of Costumes are intended for personal, family, party, event, or household use. You must not buy products from us for unauthorised resale, export, or other commercial use without our written permission.

SECTION 4 - PRICES, CURRENCY AND BILLING

Prices, discounts, promotions, shipping offers, and product availability may change without notice. Unless stated otherwise, prices shown on our website do not include customs duties, import taxes, local taxes, carrier fees, or other charges that may apply in your country. If these charges apply, they are your responsibility and may be collected by your local customs authority, carrier, payment provider, or other relevant party. Lots of Costumes is built for international customers. Prices may be displayed in different currencies depending on your location, Shopify settings, payment provider, or market settings. The final price, currency, taxes, shipping charges, and any available payment options will be shown at checkout before you complete your order. We may offer promotions or discounts from time to time. Promotions may have their own conditions, time limits, exclusions, or availability limits. If a promotion has separate terms, those terms will apply alongside these Terms. You agree to provide current, complete, and accurate billing, payment, shipping, and contact information. You also confirm that you are authorised to use the payment method provided. If we identify a pricing error, payment issue, suspected fraud issue, stock issue, or checkout error, we may cancel, refund, decline, or contact you about the affected order.

SECTION 5 - SHIPPING AND DELIVERY

Our Shipping Policy explains our current processing times, estimated delivery timeframes, tracking process, international delivery notes, and delivery issue process. Most orders are expected to be processed within 1-3 business days, excluding weekends and public holidays. As a guide, orders are expected to arrive within approximately 2-5 business days after dispatch. These timeframes are estimates only and are not guaranteed. Delivery may take longer because of product availability, supplier processing, fulfilment partner delays, customs processing, local carriers, public holidays, weather, high order volumes, or events outside our control. If your order includes more than one item, items may ship separately from different fulfilment partners. You will not be charged extra shipping if this happens. International customers are responsible for checking any local import rules that may apply. If duties, taxes, import fees, or carrier charges apply in your destination, these may be charged by your local customs authority or carrier and are not controlled by Lots of Costumes. If your parcel appears delayed, missing, or delivered but you cannot find it, contact us at support@lotsofcostumes.com with your order number and the email address used at checkout. We will help check the order status.

SECTION 6 - INTELLECTUAL PROPERTY

The Lots of Costumes website, brand elements, text, graphics, images, product content, layout, design, logos, and other materials are owned by or licensed to Lots of Costumes, Ruddle Marketing, Shopify, our suppliers, our service providers, or other relevant rights holders. Lots of Costumes is powered by Shopify, which helps us provide our online store, checkout, and related services. However, any sale or purchase made through our store is made directly between you and Lots of Costumes, operated by Ruddle Marketing. By using our website or placing an order, you understand that Shopify is not responsible for the products we sell, the content we publish, our fulfilment process, our customer support, or any issue connected with a sale between you and Lots of Costumes. To the fullest extent allowed by law, you release Shopify and its affiliates from claims, damages, losses, liabilities, or issues arising from or related to purchases and transactions with Lots of Costumes. This includes, without limitation, loss of profits, loss of revenue, loss of savings, loss of data, replacement costs, loss of opportunity, event disruption, missed event dates, or similar losses arising from or related to your use of our website, services, products, content, checkout, shipping, delivery, or any products purchased from us. To the fullest extent allowed by law, our total liability for any claim connected with an order will not exceed the amount you paid for the product or order giving rise to the claim. We may control the defence or settlement of any claim covered by this section, where legally allowed. You agree to cooperate reasonably with us in responding to any such claim. Nothing in this section limits any rights or protections that cannot legally be excluded.

If any part of these Terms is found to be unlawful, invalid, void, or unenforceable, that part will be enforced to the fullest extent allowed by law. If needed, the affected part will be treated as removed from these Terms. The rest of the Terms will continue to remain valid and enforceable.

If we do not immediately enforce any right or provision of these Terms, that does not mean we have waived that right or provision. Any waiver must be in writing to be effective.
